Terms & Conditions

By placing an order with Shirts & Caps, Inc. d/b/a ClassB.com, (hereinafter referred to as SELLER or WE), you (hereinafter referred to as BUYER or YOU) are subject to these terms. All orders subject to acceptance by main office.

Warranty

ALL sales are final and there is NO WARRANTY of any kind. No officer or agent of Seller is authorized to give a greater or different warranty. The customer's remedies, as stated below for defective goods, are exclusive, and the customer shall in no case be entitled to reject any goods except from non-conformities which substantially impair the value thereof.

Payment

Payment in full is required when you place your order. All payments to be made to ClassB.com or Shirts & Caps, Inc. With approved credit, terms are NET by RETURN MAIL. Unpaid balances of 10 days and over are subject to a service charge of 1.5% per month which is an annual rate of 18%. Should it be necessary for Seller to retain the services of an attorney, the Buyer agrees to pay ALL costs of collection including, but not limited to, reasonable attorney fees.

Sales Tax

All orders shipping to Florida are subject to Florida State sales tax. Florida state sales tax varies from 6% to 7.5%, depending on the county of delivery.

Backorders

Colors and sizes are not always available, you will be contacted if an item is discontinued or temporarily out of stock. You may choose to alter your backordered items to any other size, color, or style of garment of equal value, delay your entire order until the backordered items become available, or request a refund. Final order quantities cannot be guaranteed as some items may be short shipped to maintain our high level of quality. You will not be billed for any items not shipped.

Missing Items

Your order count is confirmed and checked no less than three (3) times during the course of your order. You must be present when your order is first opened and must report any missing items within three (3) days of receiving your order. While it is not possible to replace missing items, we will either issue a refund for the missing items or, at our discretion, recall the entire order and issue you a full refund. If we recall the order, we will pay the cost of return shipping.

Garment Sizes

Since each garment is made by hand, sizes vary from one shirt to the next. We cannot guarantee size consistency. You are responsible for ordering the correct sizes for your group. We make every effort on each product page to provide sizing information. Our name brand garments are the most popular in our industry so most of our customers already have the same style of t-shirts already. We offer Jerzees™ and Gildan® size sample kits that can be ordered in advance to help you get accurate size information for your order.

Trademarks

All items are custom made to your specifications. We have limited license rights and can only produce designs containing trademarked images that are approved by the Licensor of the trademark. If your design contains a trademarked or copywrited images owned by a third party with which we have no license, you warrant that you have been authorized by the copyright or trademark owner or agent to have that design manufactured by us on your behalf. We accept no liability for copyright or trademark infringement on designs submitted by you and manufactured by you. By submitting a design of a copy written or trademarked design, you warrant that you have been authorized by the copyright or trademark owner or agent to have that design manufactured by us on your behalf and shall indemnify, defend and hold Seller and its officers, shareholders, employees and agents harmless from and against any claims, damages and costs, including attorneys' fees and costs, in any infringement actions as a result of printing the artwork.

Turnaround Time & Production Schedule

We start counting turnaround time when we receive all of your order specifications and payment in full. Orders placed after 3 P.M. Eastern Standard Time count for the next business day. Your proof will be available within two (2) business days (complex designs and stock designs marked as "extended turnaround" may take up to five (5) business days). You may make changes to this proof and revised proofs will be posted promptly. Our turnaround time expects that final proof approval will occur within two (2) days of the initial proof being provided for standard turnaround orders and within one (1) day for rush orders. Any delay beyond this will result in a corresponding delay in your order's estimated arrival date.

It is your responsiblity to provide a working and reliable email address when you place your order and to ensure that emails from Seller will not be blocked by spam filtering software. If you cannot provide an email address, we will send your proofs by fax or USPS mail. Orders which cannot be proofed by email have a turnaround time of four (4) weeks.

Business days are Monday through Friday, excluding federal holidays and weekends.

We provide estimates of arrival dates. We cannot be held responsible for delays during shipping.

Turnaround time guarantees do not include unforeseeable delays, such as those caused by natural disasters or product shortages.

Shipping Liability

We are not responsible for damage or loss to your order in transit. Any damage or tampering with your order must be reported immediately to the carrier.

Manufacturing Defects

We have rigorous inspection procedures. Every single item in your order is inspected no less than three (3) times for construction quality and decoration quality. If any item in your order contains a defect in manufacturing or decoration, you must contact us within seven (7) days of receiving your order. While it is not possible to replace defective items, we will either issue a refund for the specific items you are unhappy with or, at our discretion, recall the entire order and issue you a full refund. If we recall the order, we will pay the cost of return shipping. We cannot accept or refund any garments that have been washed or worn.

Return Policy

All items are custom made to your specifications. We do not accept returns except as allowed by our manufacturing defects policy.

Artwork

We retain ownership of all original artwork. You retain ownership of artwork you submit to us. However, by submitting artwork, you grant Seller a license to modify, reuse, resell, your artwork for any purpose including using your artwork in promotional materials.

Production Materials

We retain ownership of all production materials, including negatives, positives, dies, film, screens, electronic files, and other proprietary materials. Most production materials are destroyed during the process or recycled as soon as the order is completed. Electronic files are retained for our use but can not be made available to Buyer.

By placing an order with Seller, you agree to be bound by these terms. If you do not agree to these terms, do not place an order.
